These Terms and Conditions govern the use of Nautiq's website and the booking of yacht tour services. By accessing this website or making an enquiry or booking, you agree to these terms. If you do not agree with any part of these terms, please refrain from using our services.

1. Definitions

"Nautiq" or "We/Us/Our" — Nautiq Sdn. Bhd., registered in Malaysia, operating yacht tour services from Kuala Lumpur.

"Service" — any yacht tour offered and described on this website, including day tours and multi-day expeditions.

"User" / "Guest" — any person accessing this website or booking a tour.

"Agreement" — these Terms and Conditions, together with any booking confirmation issued by Nautiq.

"Content" — all text, images, and other material on this website.

2. Acceptance of Terms

By using this website or making a booking, you confirm that you are at least 18 years of age and have the capacity to enter into a binding agreement. If booking on behalf of others, you confirm you have authority to accept these terms on their behalf.

3. Service Description

Nautiq offers three private yacht tours departing from the Klang Valley region of Malaysia: the Marina Bay Morning Glide, the Straits Sailing Day Experience, and the Multi-Day East Coast Expedition. Tour descriptions on this site are accurate at time of publication but may be subject to change due to vessel availability, seasonal conditions, or safety considerations.

All tours are private — each booking takes the full vessel. Nautiq does not operate shared or public departure tours.

4. Booking and Payment

Bookings are confirmed upon receipt of a deposit as communicated by our team. Full payment is required prior to the tour date. Prices are listed in Malaysian Ringgit (MYR) and are per booking, not per person. Pricing includes crew, vessel, meals described in tour details, and standard safety equipment.

Payment terms and accepted methods will be communicated at the time of booking confirmation.

5. Cancellation and Rescheduling

Cancellations made more than 14 days before the tour date are eligible for a full deposit refund. Cancellations within 14 days but more than 7 days before departure will result in forfeiture of the deposit. Cancellations within 7 days of departure will be charged at the full booking price.

Nautiq reserves the right to reschedule or cancel a tour due to adverse weather, vessel maintenance requirements, or other safety-related considerations. In such cases, a full refund or reschedule at no additional cost will be offered.

6. User Responsibilities

Guests are expected to arrive on time, follow all crew safety instructions, and conduct themselves in a manner that does not endanger themselves or others onboard. Guests with known medical conditions relevant to sea travel should inform Nautiq prior to departure.

Guests must not bring prohibited items onboard including controlled substances. Nautiq reserves the right to refuse boarding to any guest who appears impaired or poses a safety risk.

7. Intellectual Property

All content on this website including text, imagery, and design belongs to Nautiq or is used with permission. Content may not be reproduced, copied, or distributed without our written consent. Guests may share photographs taken on their own devices for personal use without restriction.

8. Disclaimers

Tour experiences are subject to natural conditions including weather, sea state, and wildlife presence. Nautiq cannot control these factors and does not make assurances about specific sightings, conditions, or outcomes. The website content is provided as general information and does not constitute professional advice of any kind.

9. Limitation of Liability

Nautiq's liability to guests is limited to the value of the booking in question. We are not liable for indirect, consequential, or incidental losses arising from tour participation, force majeure events, or circumstances beyond our reasonable control. All tours are conducted with appropriate insurance coverage for direct liability to guests.

10. Governing Law & Dispute Resolution

These terms are governed by the laws of Malaysia. Any dispute arising from these terms or from the provision of services will first be approached through informal resolution. If this is unsuccessful, disputes shall be subject to the jurisdiction of the courts of Kuala Lumpur, Malaysia.

Guests may also refer complaints to the relevant consumer tribunal under Malaysian consumer protection law.

11. Changes to These Terms

We may update these terms from time to time. The current version is always available on this page with a revision date. Continued use of our site or services after changes constitutes acceptance of the revised terms.
